These Terms & Conditions ("Terms") govern your use of the Reps mobile and web application (the "Service") operated by Sundarapilates LLC ("we", "us", "our"). By creating an account or otherwise using the Service, you agree to these Terms.
1. The Service
Reps is a subscription-based fitness and rehab tracking application that lets users save workouts, build rehab plans, set reminders, and access related features.
2. Eligibility & Accounts
You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account, and you agree to provide accurate information and keep it up to date.
3. Acceptable Use
You agree not to misuse the Service. In particular, you must not:
- Use the Service for any unlawful, fraudulent, or harmful purpose;
- Send spam, malware, or content that infringes intellectual property or privacy rights;
- Probe, scan, scrape, or interfere with the security or integrity of the Service;
- Reverse engineer, resell, redistribute, or circumvent any technical limitation of the Service.
4. Intellectual Property
Sundarapilates LLC retains all right, title, and interest in and to the Service, including its software, content, design, and branding. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service for your personal, non-commercial purposes within the limits of your active plan.
5. User Content
You retain ownership of any content (such as workouts, notes, and rehab plans) that you submit to the Service. You grant us a limited license to host, store, and process that content solely to provide and improve the Service for you.
6. Payments, Subscriptions & Refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. 7. Service Availability
We work hard to keep the Service running, but we do not guarantee that it will be uninterrupted, error-free, or available at all times. The Service is provided on an "as is" and "as available" basis, and to the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
8. Suspension & Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for: (a) material breach of these Terms; (b) non-payment; (c) security or fraud risk; or (d) repeated or serious policy violations. On termination, your right to use the Service ends and we may delete your account data after a reasonable period.
9. Limitation of Liability
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or related to the Service is limited to the fees you paid to us in the twelve (12) months before the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or special damages (including loss of profits, data, or goodwill). Nothing in these Terms limits liability that cannot be limited by law (such as for fraud or personal injury caused by negligence).
10. Indemnity
You will indemnify and hold Sundarapilates LLC harmless from any claims, losses, or expenses arising out of your content, your unlawful use of the Service, or your breach of these Terms.
11. Health Disclaimer
Reps is a fitness and rehab tracking tool. It does not provide medical advice. Consult a qualified healthcare professional before starting any exercise or rehabilitation program.
12. Changes to the Service or Terms
We may update the Service and these Terms from time to time. Material changes will be communicated through the Service. Continued use after a change means you accept the updated Terms.
13. Governing Law
These Terms are governed by the laws of the State of California, USA, without regard to its conflict of laws rules. Disputes will be resolved in the state or federal courts located in California.
